Terms of Use

1. Provider and scope

The provider is myndfree – Luis Brummer (address: see imprint). Use of the app is governed by Apple's Standard License Agreement (EULA); these terms supplement it. By tapping “Let's go” in the introduction you agree to them (notice with link right at the button, no checkbox); the app stores the time and version on your iPhone. Where they conflict, mandatory consumer protection law takes precedence.

2. Service

Myndfree automatically plans appointments, tasks, habits, sleep and journeys. Some features use third-party services (Apple Maps, Apple Health, calendars, Notion, AI from Anthropic). We cannot guarantee their availability or accuracy; outages do not cause loss of your data on the iPhone.

2a. Age

Myndfree is for people aged 16 and over. In the introduction you confirm that you are at least 16. Younger people may not use Myndfree.

3. Subscription, trial, cancellation

Subscriptions (Myndfree Minimum, Myndfree Pro – monthly or yearly) and the 7-day trial are taken out and paid for through your Apple account. They renew automatically unless you cancel in your Apple account settings at least 24 hours before the end of the current period. Withdrawal and refunds follow Apple's terms. Without an active subscription the app is locked after the trial; your data stays stored and can be exported.

3a. Account

  • To use Myndfree you need a free account; you create it the first time you sign in (Apple, Google or email code). Until the encrypted backup is available, you can still skip signing in within the app.
  • Protect your access (your email inbox or your Apple or Google account) and do not share sign-in codes.
  • A subscription is always linked to exactly one account. If you sign in to the app with a different account, the link moves there.
  • You can delete your account at any time in the app or on myndfree.com. Deleting it does not end your Apple subscription – you can only cancel it in your Apple account settings.
  • In the event of serious breaches of these terms (e.g. under 4 or 5a), we may block or delete an account and will tell you why.

4. AI features and allowance

  • The subscription includes a number of AI requests per calendar month (Minimum and trial 300, Pro 1,000). Unused requests from the subscription expire at the end of the month.
  • AI add-on pack: 300 additional requests as a one-off purchase through Apple. Purchased requests do not expire, are used only after the monthly allowance, are not transferable, cannot be paid out in money and can only be used with an active subscription.
  • AI results are marked as such and may be wrong. Check entries before relying on them.
  • To prevent misuse, the AI features may only be used through the app and not in an automated way; circumventing the allowance is prohibited.

5. Your obligations

Use Myndfree only within the law. Do not enter third-party data you are not entitled to process. Do not operate the app while driving. For public content (e.g. community wishes, once available): no unlawful, offensive or promotional content; we may remove such content and will tell you why. You can report unlawful content at any time to info@myndfree.com.

5a. Protection of intellectual property – no copying

  • The Myndfree app, its program code (source and object code), its planning logic in the form implemented, its interfaces, graphics, texts, animations, the website myndfree.com and the name and logo "Myndfree" are protected by copyright, trademark and unfair competition law (in particular §§ 2, 69a ff. UrhG, MarkenG, § 4 No. 3 UWG and the protection of trade secrets under the GeschGehG). All rights belong to the provider.
  • You receive only a simple, non-transferable right to use the app within your subscription for your own private purposes. No further rights are granted.
  • In particular, you may not: copy, rebuild or imitate the app, the website or parts of them, or distribute them in a similar design; decompile, disassemble or otherwise reverse engineer the program code, except where § 69e UrhG mandatorily permits this; take over interfaces, texts, graphics or animations in whole or in part; read out the app, its interfaces or servers in an automated way (scraping) or use them to develop or train a competing product (including with AI systems).
  • Infringements can give rise to civil claims for injunction, removal, information and damages (§§ 97 ff. UrhG, §§ 14 ff. MarkenG, §§ 8 f. UWG) and can be punishable under §§ 106 ff. UrhG, § 143 MarkenG and § 23 GeschGehG. We reserve the right to take legal action and to file criminal complaints. In the event of an infringement we may block your access and terminate the contract without notice.
  • Mandatory statutory rights of use (e.g. § 69d UrhG) remain unaffected.

5b. Test phase before launch (TestFlight)

  • Before launch in the App Store, Myndfree can be tested via Apple's TestFlight. Test versions are not finished: features may be missing, change or have bugs, and Apple lets every test version expire after at most 90 days. So back up regularly (automatically to iCloud Drive or as a file).
  • Apple's TestFlight terms also apply during the test phase. Purchases in a test version are test purchases and cost nothing.
  • Feedback is voluntary. We may use hints and suggestions you send us free of charge to improve Myndfree. For shared voice commands and other personal data, the privacy policy applies (section 6e); you can withdraw your consent at any time.

6. Important notes

Travel times, traffic, alarm and departure suggestions are estimates. Allow a buffer for important appointments. The stress value from Apple Health is not a medical finding; Myndfree is not a medical device.

7. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In cases of slight negligence we are liable only for breach of essential contractual obligations and limited to the foreseeable, typical damage. Back up important data regularly (export in the app).

8. Changes

We may change these terms with effect for the future if the app or the legal situation changes. We will inform you of significant changes in the app; you can cancel the subscription at any time through Apple.

9. Law and dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection law of your country of residence remains unaffected. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
